چکیده

The controversy surrounding patenting deoxyribonucleic acid (“DNA”) is hardly new. The first patent on a gene was granted by the United States Patent and Trademark Office (“PTO”) two decades ago, in 1982. As biological research was advancing rapidly in the 1980s, two trends combined to encourage the patenting and commercialization of DNA: the passage of pro-economic growth legislation and the emergence of the biotechnology industry. Since then, the PTO has granted over 40,000 patents on DNA, a practice that some say “challenge[s] [the] longstanding norms of sharing and openness” in biological research. Add to that concerns that DNA patents may stifle development in the name of commercial gain, offend the inherently personal nature of DNA, and raise bioethical dilem-

Patentability of inventions related to biotechnology and genetics has been one of the most challenging issues in patent law. One of these challenges is whether patenting products in which natural components are used is correct? Can we put human genes in the ownership of certain individuals? In addition, exercising exclusive rights arising from patents will limit the access of people, in particu...

Dialogue Concerning Natural Appropriation

Two utilitarian defenses, traceable to Bentham and Mill, are commonly offered for patents. It is contended that patents induce innovation, and that patents induce disclosure of innovation. Patents on some or all of the human genome pose particular challenges for these defenses. In the first instance, patents on nucleotide sequences entail the perverse notion of human reproduction qua infringeme...

Evaluation of Rights Related to Public Health and Pharmaceutical Patents and Existing Conflicts According to National and International Laws

Today, along with the relative expansion of public health around the world, various diseases such as AIDS, malaria, etc. are increasing in human societies. In this regard, the pharmaceutical industry is one of the most important industries that should be supported so that the inventors of new drugs have enough motivation to produce more effective drugs. On the other hand, the undeniable benefit...

Recent patents on agrobacterium-mediated gene and protein transfer, for research and biotechnology.

Agrobacterium has been widely used, in the last decades, for genetic transformation of a large number of plant species, and the genes and DNA sequences involved in this process have been subject of numerous patents. This review focuses on recent discoveries, which have shown new possibilities for the utilization of this versatile microorganism. For example, the identification of an ever-increas...
